Privacy Policy for Temply

This Privacy Policy explains how Lev Gieseler ("we", "our", "the Company") collects, uses, and protects personal information through the Temply Shopify application ("Temply", "the App"). By installing or using the App, you agree to the practices described in this policy.

Lev Gieseler is the data controller for personal information processed in connection with the App.


2. Information We Collect

2.1 Information from Merchants

When you install Temply, we access and store the following information through the Shopify API, based on the permissions you grant during installation:

  • Store details (store name, primary domain, store ID, contact email, country, currency, timezone)
  • Theme data necessary to add, update, or remove templates and sections
  • Page content created or edited through the App
  • App configuration and template settings
  • Account and billing identifiers required to manage your subscription (no payment card data is collected by us; all payment processing is handled by Shopify)

We do not collect passwords, Shopify login credentials, or payment card numbers.

2.2 Information from Store Visitors

Temply does not collect, track, or store personal information about your store's visitors or customers. Pages built with Temply render through your Shopify storefront and inherit your store's existing tracking, cookies, and analytics setup. Any data collection on those pages is governed by your own store's Privacy Policy and the third-party tools you have installed.

2.3 AI-Generated Content

If you use the AI page generation feature, the prompts you submit and the metadata required to generate output are sent to our AI service providers for processing. These prompts may be temporarily processed and logged for the purpose of generating responses, monitoring service quality, and preventing abuse. We do not knowingly submit personal information of your customers to AI providers. You are responsible for not entering personal information of third parties into AI prompts.

2.4 Automatically Collected Information

We collect limited technical information for functionality, diagnostics, and security:

  • IP address of the merchant device accessing the App
  • Browser type and version
  • Device and operating system information
  • Interaction logs with the App interface
  • Error logs and performance metrics

This information is used only to operate, secure, and improve the App.


3. How We Use Your Information

We use the information we collect to:

  • Operate and provide the features of the App
  • Install, update, and remove templates and sections in your theme
  • Generate AI-powered page content when requested
  • Respond to merchant support requests
  • Process billing and manage subscriptions
  • Maintain security, detect fraud, and prevent misuse
  • Comply with legal obligations
  • Improve the App through aggregated, non-identifying usage analysis

We do not sell or rent your information to third parties. We do not use your data to train AI models.


4. Legal Basis for Processing (GDPR)

For merchants and visitors located in the European Economic Area, United Kingdom, or Switzerland, we process personal information on the following legal bases:

  • Performance of a contract: to provide the App and fulfill our obligations under our Terms of Service
  • Legitimate interests: to secure the App, prevent abuse, and improve our services
  • Legal obligation: to comply with applicable laws and regulations
  • Consent: where required by law, and which you may withdraw at any time

5. Sharing Your Information

We share information only under the following circumstances:

  • Service providers: We use third-party infrastructure, hosting, AI, and analytics providers that support the App. These providers are bound by confidentiality and data protection agreements and process data only on our behalf. Key categories include cloud hosting, error monitoring, and AI inference providers.
  • Shopify: We exchange information with Shopify as necessary to operate the App within your store.
  • Legal compliance: We may disclose information if required by law, regulation, court order, or governmental request.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, information may be transferred in accordance with this Policy.

We do not share merchant or store information with third parties for marketing or unrelated analytics purposes.


6. International Data Transfers

The App may process information in countries outside your own, including outside the European Economic Area. When we transfer personal data internationally, we rely on appropriate safeguards such as Standard Contractual Clauses, adequacy decisions, or other legally recognized mechanisms to ensure your data remains protected.


7. Data Storage and Security

We store information using industry-standard security measures designed to protect data against unauthorized access, disclosure, alteration, or destruction. These measures include encryption in transit, access controls, and regular security reviews. No system can be guaranteed to be 100% secure, but we work to protect your data using reasonable safeguards.


8. Data Retention

We retain merchant data for as long as the App is installed and your account is active. When you uninstall the App or close your account, we delete all associated personal information within 30 days, unless a longer retention period is legally required (for example, for tax, accounting, or fraud-prevention purposes).

Aggregated, anonymized data that cannot be used to identify you may be retained for analytical purposes.


9. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal data:

  • Right of access to the personal data we hold about you
  • Right to correction of inaccurate or incomplete data
  • Right to deletion ("right to be forgotten")
  • Right to restrict or object to processing
  • Right to data portability

10. Children's Privacy

The App is not intended for individuals under the age of 16. We do not knowingly collect personal information from children. If we learn that we have collected such information, we will delete it promptly.


11. Cookies

The Temply admin interface may use essential cookies and local storage to maintain your session and remember your preferences. The App does not place cookies on your store's customer-facing pages. Any cookies on your storefront are controlled by Shopify, your theme, and the third-party apps you have installed.


12. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this Policy indicates the date of the most recent revision. Material changes will be communicated through the App or by email. Continued use of the App after changes take effect means you accept the updated Policy.
